1 – INTRODUCTION
The website www.mariachocolate.pt is an integral part of the company MARIA CHOCOLATE PORTUGAL, LDA , with Tax Number 514801174 and registered office at Rua do Palacete, nº 84, Serzedo 4410 – 039 Serzedo, henceforth referred to as Maria Chocolate.
These terms and conditions regulate your interaction with our website when creating an online account, subscribing to the newsletter and entering into contracts for the purchase and sale of products marketed by us, in accordance with the requirements of Decree-Law No. 24/2014 of 14 February.
Maria Chocolate also has a Customer Support service where all necessary explanations can be provided and where it is possible to present suggestions or complaints. This service is available through the e-mail info@mariachocolate.pt
The creation of an account, the subscription to the newsletter and the conclusion of any purchase imply the acceptance of the present terms and conditions.
2 – CONDITIONS OF USE
Site users must be at least 16 years of age to create an account, subscribe to the newsletter and make purchases. The purchase of products containing alcohol in their composition is reserved to persons over 18 years of age.
It is the sole responsibility of the user to provide false or inaccurate information necessary for the use of the site
To perform transactions in our online shop is not required to create a customer account.
3 – NEWSLETTER SUBSCRIPTION AND ONLINE CUSTOMER ACCOUNT CREATION
3.1 – Newsletter
Our site has a newsletter available for optional subscription, which eventually aims to inform its subscribers of new products, as well as promotions and campaigns that are in force at any given time.
To subscribe to the newsletter, the user only needs to indicate his/her e-mail address and first and last name. The user may, at any time, cancel the respective subscription through the link provided in all newsletters sent.
To subscribe to the newsletter, the user must be over 16 years of age, and will be responsible for any false statements made at the time of subscription.
3.2 – Client Account Creation
When the customer chooses to create an online account he will have to indicate his username, an email address and, additionally, provide a password.
The validation of the online account is made through a link sent to the email address provided and that must be validated.
After validating your account and once logged in, the customer has at his disposal the possibility of changing your registration data, including contacts and password, may also insert addresses to which you want the shipment of your products.
To create an online account the customer must be over 16 years of age, and the provision of false statements is the sole responsibility of the customer.
The creation of an online account will facilitate the purchase process and will allow the consultation of the history of orders, being, however, not mandatory the existence of a customer account so that purchases can be made.

4 – PRODUCTS AND PRICES
Maria Chocolate displays in its online shop all the products it commercialises, indicating their characteristics and ingredients, in accordance with the legislation in force, exhibiting images of the products that correspond to presentation suggestions. However, as it is a handmade production, Maria Chocolate does not guarantee that all its products are a faithful reproduction of the images presented.
The prices of the products already include the applicable Value Added Tax (VAT) and the price may vary. However, the prices of the article to be ordered always correspond to the prices announced on the website on the day you place your order.
When discount campaigns are in force, the value of the products after applying the discount is visible whenever the customer selects the product he wants to buy, and the price of the products before and after the discount is applied is also visible in the shopping cart.
If the customer is in possession of a coupon or discount code, the discount is only applied at the time of finalising the order and always before payment.
The Site, whenever possible, indicates if the selected product is available, or the expected time for its availability. However, although every effort is made to ensure that the information is always up to date and as accurate as possible, it is not possible to exclude the existence of failures as to the level of availability of certain products, so that direct contact may be made with the customer, by telephone or email, giving notice of the out of stock, or alternatively, through a message on the website or social networks.
The Site offers products that can be customised by the customer. When finalising the purchase, the customer indicates, in a specific field for the purpose, the desired customisation, receiving by email the project proposed by the design and customisation services. The customer has the right to only one alteration, without any additional cost. However, subsequent alterations are subject to an additional cost of €15.00, corresponding to the design and personalisation service fee.
5 – PURCHASE, PAYMENT METHODS AND POSTAGE
To make purchases on the site, it is not necessary to create an online account, however, when the customer has an online account he can manage his payment methods, shipping addresses and invoicing data.
The purchasing process is simple, with the customer having to select the products they wish to purchase and the respective quantities, adding them to their shopping cart.
When finalising the order, the customer may apply discount coupons, if any, under the terms referred to above.
To place an order, when you do not have a customer account, you must provide your name, address, VAT number, e-mail and mobile phone.
After finalizing the order, the customer has at his disposal the possibility to pay by Credit/Debit Card, Multibanco and Paypal.
Cash payment is only available for orders of non-customizable products and if the customer chooses the option of withdrawal in shop, provided that the value of the operation does not exceed €500 (five hundred euros).
If after confirming the order, the customer does not pay within 48 hours, the order will be automatically cancelled.
Orders processed on the website are subject to payment of shipping costs, unless the Customer chooses the option of collection in shop.

6 – CANCELLATION AND REFUND
Whenever payment by ATM is chosen and it must be made within 48 hours, otherwise the order is automatically cancelled.
In the following 24 hours after payment confirmation the order, which does not contain customizable products, can be cancelled without any additional cost and the amount paid is returned through the same means of payment used.
It should be noted that the cancellation of customisable orders is subject to payment of a service fee of €15 and can only take place within 24 hours of payment confirmation.
Without prejudice to the applicable legislation regarding guarantees on consumer goods and the rights recognised in the event of non-compliance of the product, the customer will not benefit from the right to free termination of the contract entered into given the nature of the products ordered, as these are rapidly perishable products.
7 – INTELLECTUAL PROPERTY, LIABILITY
All content displayed in this website is protected by Copyright, Related Rights and Industrial Property Rights, in line with the Portuguese and European legislation in force and may not be used, reproduced or copied without the consent of Maria Chocolate.
Maria Chocolate rejects any responsibility for direct, indirect or incidental damages resulting from misuse and inability to use the products sold. Maria Chocolate reserves the right to interrupt or suspend access to the website, whenever it considers necessary and for the period of time it considers convenient, either for administrative reasons, force majeure or technical reasons.
8 – AMENDMENTS, UPDATES AND INTERPRETATION
Maria Chocolate reserves the right to change the graphic image and content of its website and to update its terms and conditions without prior notice and without prejudice to the rights already acquired by virtue of contracts entered into under previous versions of the Terms and Conditions. All changes will be available on the site and must be consulted at each use.
These terms and conditions shall be interpreted in accordance with Portuguese law and the Portuguese courts shall have exclusive jurisdiction to hear and settle any dispute that may arise from the use of our site.
